I am currently being sued by 2 credit companies of non-payment of credit cards. Long story short, I am currently filing for bankruptcy, however because I don't have enough funds to completely file, I am currently in limbo until the BK funds are paid and we (my lawyer and I will file). In the meantime, my lawyer tells me that we can most likely file for an extension, so that I can have the complete funds to file. My questions is can these credit card companies still put me in a position to "pay" them, the lawyers even if I file bankruptcy? I am filing for chapter 7. what's the ugliest thing that can happen in cases like this? Please anybody's response to this question or any help that they can give me is greatly appreciated. Thank You!

Have you told them you are filing Chapter 7? Don't pay them anything as the Chapter 7 will discharge this debt. Be sure your attorney includes these 2 credit cards with the proper account numbers, amounts owed, addresses, and court case numbers. Just inform the credit card company you are filing bankruptcy and your attorney's name is so and so and his phone number is such and such and hang up the phone. Don't talk to them, negotiate with them, etc. They will call your attorney's office to validate you actually are filing Chapter 7. You should not hear from them again after they call your attorney's office. Relax. As soon as you file you'll be fine. The worst thing is the credit card company does not get their money.

Thanks for the info tweenkie. No I have not informed any of these creditors yet, that I have filed the chap 7, I will eventually leave that up to my lawyer to do just that as soon as I come up w/the complete payment. They are however included in the bankruptcy, as well as all the others. I am just not getting any sleep and exhausted because of these law suits. Thanks again for your response. Q

The worst thing that could happen is that they could sue you and while the case is travelling through the legal system you would file in bankruptcy.
