View Full Version : Judgment passed in Georgia/Time frame to vacate

Mann Bracken got a judgment against me in Georgia. Does anyone know the time frame to vacate? Also this company had ignored my validation letter and the judge ruled and said I was not entitled to it. Thought this was unfair , as I was not even given a day in court.

Did you go to court on your court date? Was this a default judgement? Did you receive a summons to apperar in court? A little more information may help us better advise you.

No I was never given a court date. The judge said she is able to grant because she is the judge. Said mann bracken does not have to validate . Mb does not fall under the definition of a debt collector. When all their correspondences have said "debt collector. I had sent the photo copies to the court in my answer. Also said I did not file in a timely manner. Mb 's letter was signed 8/15/2008, I replied with letter to court dated 8/26/06. Court got it via certified mail 8/27/08.
I am going to the court to tile motion to vacate. Mb has continued to call me, even just now. But I want my day in court.
I got the judgment in the mail 9/13/08. Was stamped by court clerk 9/10/08. The order said that my motion would not be ripe until 9/17/08, but she granted judgment anyway.
