So I got a dui in August of 07, and it was over on May 2008, but I am still on a 3 year probation. However, I recently got into another accident, with alcohol in my system. The cops did the field sobriety test, and I passed with a .05, so I did not go to jail nor ticketed. My question is since a report was filed, and I know my car is totalled and my insurance company has to notify the DMV, will this be a violation on my probationary period. I was not ticketed, nor went to jail, not was my license taken away. I went home that night. I am just wondering if the DMV will suspend my license for a year... :(:confused:

Quite likely since you were on probation already. Your best advice would come from a local lawyer who deals with DUI a lot.

Several issues, on probatoin you were most likely not to be drinking at all, so the report of that accident will show you had been drinking.
And of course you are suppose to notify the PO of incidents

Sounds like you violated again. Best to come clean with your PO before they find out as they do computer checks on probationers every so many months and this doozy will definitely ring their bells in the office.
