Hello,
I posted on this site quite a while ago about assuming the mortgage of my deceased husband.
I did not assume the mortgage. I paid off the manufactured home in Aug. of 2007. I received the papers the loan was satisfied and continued to look for the title and deed to my manufactured home.
In November of 2007, I contacted the bank and asked for the title to be sent to me. I was informed that they did not have the title and that I should get it from the County DMV. I live in Florida, by the way. I called the County office to find out what I needed to bring with me to get the copy of the title and deed. I was informed that someone else owned my home and land.
I went to DMV to find out what was going on. I had the papers from the bank that should my home was paid off. The DMV office told me that they had no record that the bank I paid had a lean on my home and that someone else, a finance company had taken title to my home in 2005. Two years before I paid the bank. I went straight to the bank and they had no idea what was going on and said they could do nothing and that they were the only ones with a lean on my home.
I returned to the DMV office and through persistence found that the home that was registered under my name as my home was not the home that I have purchased. The dealer or the Title Company had given me the incorrect MSO to register my home as real property.
DMV has determined that the home that is registered to me is not the one that I live in and is not the one that I purchased. But, DMV has not been able to get the Manufacturer nor the dealer to issue the correct title. DMV also found out that my home has never been registered. I later found out that half of the home, that is incorrectly registered, is owed my me and the other half of my double wide is not.
I have said all of this because I would like to find out if I have grounds to sue the Manufacturer, dealer, or the bank that had the mortgage for a month or the bank that I paid off.
I am not sure what I should do to get the matter cleared up.
