Just want to find out how child support is terminated by the state of VA now that child has turned 18 and graduated high school, actually graduates in 3 or so weeks. Will a phone call by myself or attorney be able to have the court stop the payments or does my employer just stop the witholding order since the law says the support stops when the child has turned 18 and has graduated high school. Any help would be greatly appreciated. Thanks!

I am not an attorney, or in VA, but in our state the attorney must call the court with documentation of age and graduation to have child support stopped.

I gather your salary is being garnished for these payments. If that's the case, ask your employer to see the court order they received to initiate the garnishment. This court order should spell out the term of the garnishment. If no specific end date is listed, you need to do some work here. If the court order specifies it ceases when the child graduates HS, then you will need to show proof to your employer of that. You may also need to get the court to rescind or end the order.

But he is on the track there. Your payroll department merely follows the terms of the court order. And will most likely not remember the end date.
So a call to them may be all that is needed.

If not have your attorney contact the employer and the court

In some states "Friend of the Court' handles this and all information is sent through them. If this is not your case, you can go by the guidelines that ScottGem and I both have stated.

At least you get to see him/her once in a while. We lived so far apart it did not happen for us except for every couple of years.
