View Full Version : How long do we have after foreclosure house is auctioned?

My boyfriend and I have been renting a home from his father for three years with his 10yr old and my now 3month old. We just got a notice Wednesday that our home is being auctioned off on Tuesday. What right do we have as tenants but not owners of the home? Does the new owner have to evict us or do we have to be out the day it is auctioned? If they have to evict us than how long do we have from the date of sale to move?

The new owner will have to give you a written notice to vacate the premises. The time for the notice can be anywhere from 3 to 30 days, depending on the laws in your state. If you don't vacate within that time then they have to file a lawsuit to evict you. That can take anywhere from 2 to 6 weeks before a constable will come to the door to evict you.

Can you and your boyfriend buy the house from his dad? Since he's going to lose it anyway, maybe he will transfer it to your boyfriend and all you will have to pay is the arrears.

But if you can't Lisa is correct. You will be given time after the property is sold. How much depends on state law.
