Hi, I moved to work in California since Jan21 08, I am holding L1A visa. Below are my questions:

1. I file my W4 form 3 points since jan 08, and I just got married a month ago, my husband is holding J1 visa, can he be as my dependent since he do not have income in U.S? Can I change W4 from 3 to 4 by adding him as my dependent?

2. My company is applying Green card for me, and my husband J1 visa is expired in Jun 09. Can he converts to L2 visa if by Jun 09 I am yet to get my Green Card? Will he automatically getting green card, once my green card is granted?

Thanks.

L1 is work visa and your days in the U.S. are not exempt from residency. Since you are married you can file joint return as residents even if one of you did not have any income. In this way you will both get standard deduction and exemption deduction. Read: Your U.S. Tax Return: The U.S. Visas (http://taxipay.blogspot.com/2008/08/us-visas.html)

On your tax return, you can also deduct moving expenses. Read: Your U.S. Tax Return: Moving Expenses (http://taxipay.blogspot.com/2008/02/moving-expenses.html)

The visa-related questions are LEGAL questions, and this is a TAX forum.

Recommend you post the legal questions on the LAW forum under Immigration Law.
