View Full Version : Can the employer withhold earnings? (NC)

Ok so here is the scenario... my friend is a manager of a hotel, A deposit went missing and the corporate office is saying that she is responsible for the money being paid back. She is resigning from her position as the manager. So my question is... Can the employer withhold this certain amount of money from her final paycheck? Or do they have to take other measures to obtain the money? Also we are in the state of North Carolina if that helps.

They can't just take the money - they would have to call the Police, have her arrested and either attempt to get the money back in some sort of plea deal OR plain out sue her.
Why did she resign? That makes her look somewhat guilty.
