I received a letter today from a 3rd party collections agency about a citibank mc account. I didn't recall my husband ever opening a citibank card so I called citibank direct. They told me they had no record of an account... so I called the collection agency. They informed me this account was opened in 1995!? They said no payments were made after 1998... which doesn't make any sense since we were living in the UK from 1996 - 2002 so how could we be making payments?? It is possible that hubby did open this account as he was only 19 at the time... but this has to be past the statute of limitations right?!

I should add that we live in Ontario now :)

Well, I can at least tell you one thing. My dad owned a collection agency. They won't do anything until the 3rd letter is sent. So you at least have some time to straighten it out.

In Ontario the limitation to file a lawsuit for a debt that occurred before January 2004 is six years. For a debt that occurred after January 2004 the limitation period is two years. Certain conditions apply.

A payment or a signed written acknowledgement of the debt can restart a limitation period so be careful.
