My mother in law has a live in friend who does not have a rental agreement or any thing close she is term ill now, she wants him out of the house what are his rights we live in va

This is not a landlord-tenant law issue, but a domestic one. The only thing the landlord can do is an eviction for "unauthorized occupant"... but that can only be filed against you.

His Rights?
He is a live-in friend, nothing more, and can be asked to leave.
If he refuses, then go to your local Court House, see those in the Court Clerk's Office, and they can guide you to the appropriate actions.
