How can I know?

It depends on how you entered US. If you entered US with visitor's visa or other non-immigrant, look in your I-94 (little white paper attached to your passport at the immigration), duration of stay will be in there. If you stay beyond that period, you are considered "overstay".

If you entered US with immigrant visa, you are resident.
