I was in an accident that was not my fault. I live in Richmond, VA. The accident was on private property. I was driving my girlfriend's car. Her insurance policy lapsed at 12 am this morning, and I had the accident today. There were two witnesses who stated the accident was not my fault, and I have their names and numbers. We called the other person's insurance company, but they were closed. Should we pursue the claim? Will we get in trouble for not having insurance on the car? Will the other person's insurance company not pay if we do not have insurance ourselves? I tried to file a police report, but they said one was not necessary because the accident was on private property? Will this do more harm for me and my girlfriend than good in trying to pursue this?

Ok, first you should have got a police report, you should have more fear of them claiming you caused the wreck and wanting to sue you for the damages.

But you having or not having insurance does not stop you from making a claim, but they will know you don't have any, and will not have a company to stand behind you for a law suit or settlement. So don't expect them to work with you as much as if you had insurance.
