My son graduated high school in o7, worked for a year and now is going to school full time in the fall of 08, can he go back on his dads medical in surance and does his dad have to start paying child support again We live in the state of Connecticut

What does your child support/divorce decree say?

I've seen it written both ways - I am aware of a NYS case where the daughter started College, dropped out after 1 year, worked for a year and went back and although the order required the father to pay support until she was 21 or emancipated the Court found that the break was a legal emancipation and he did not have to pay.

You may have to go back to Court to get support started again. If he was dropped from health insurance I don't know if the company will take him back so you would have to find that out.

Personally, I haven't seen it restarted once the child has graduated HS and it was stopped because they didn't continue their education. I know of many cases that it stopped even though the education did continue right after HS. If you want to know for sure you would have to go back to court but I don't think the insurance will be possible for the same reason that Judy stated. My father in law has been an allstate agent for 30 years and (while allstate isn't all companies) they would have to have a separate policy for the, now adult, child.
