I bought a car with my ex husband. We got an our marriage annulled so nothing was court ordered about shared debt. He has no job, no drivers license, and has never made a payment on the car. I am getting remarried in June 09 and I want the car in just my name. I have been paying on the car for three years and now my ex is jealous and wants to take my car. Can I get him off the title without refinanceing the car. I owe 13000 and it is only worth 5000 now. It is a 2005 dodge neon sxt. What can I do? My credit sucks, but I have never missed a psyment on the car. I live in California and was wondering if DMV can change the title because it is florence smith or joey hernandex. Any help?

I would call the company you are financing it though and explain the situation. They have records of the account and who pays it each month and can see it is your checks, not his. IF you pay it timely, you should have good credit with them and they may be willing to refinace it for you. It is worth a try. Since you have a lien holder, you cannot go to the DMV to change it, the lienholder has to do that until you pay it off.

I would make sure your ex has no keys to it and keepit garaged. You could also call your local PD and ask for advice; believe it or not, sometimes you get a good cop who actually knows their job and can be helpful...

One of you would have to sign off on the title in order to put the car in the other person's name. Even if you refinance, that will not change the title.

If you want him off, he must sign off.
