My son is three... I have spoken to his biological father and we have had a DNA test to prove that he is the father but he is not interested in having a son and has shown no interest in my son... my son is now three and I am in a stable relationship... my partner wants to adopt my son but we don't know where to start and what we need to do to get the ball rolling can anyone help?

The "sperm" father needs to give up rights, and then you will be able to start the adoption process.

But I don't know where my son's real dad is so can I still go on with my partner adopting my son?

Only if you have proven that you have tried as hard as you could to find him to give him the rights he deserved. You have to prove that to the court. Only then will they even think aobut the next step. Have you written a letter to his old address? Have you called his family? Things like that! You have to give him a chance... when was the last time you talked to him?

You start by consulting a Family Law attorney to prepare the adotpion papers. This attorney will advise you on hoe to terminate the bio father's rights if he cannot be found.

In some states yes, in others you don't.

In some states you need to be married a YEAR for adoption to go through.

You'd need to check with the courts--or again, getting an attorney for this is the best answer.

Then per the advice above, see a solicitor.
