View Full Version : Pregnant by a married man- child support

Approx. 2 years I met what seemed to be a nice man, he took me to his home and all... after become physically involved... he told me he was separated... I thought I was sticking it out because he was going to get a divorce and he cared about me...
Now I am 5 months pregnant... he doesn't plan on telling his "wife" nor has he been supportive throughout this pregnancy... he has a business, however, it is solely in the business name, furthermore... it is a cash business... meaning his income is not reported...
My question is, I have his SSN#... but him not receiving a regular paycheck or paying social security taxes, will I be able to file child support based off his tax returns?

I think you could do it that but if his income is not reported is he working under the table and therefore doesn't file taxes? I would go for it and if he doesn't pay taxes report him to the IRS and whoever you have to to get anywhere with it/

Thanks for the reply, but by him not paying taxes in his name- do you assume I won't get anything for child support?

He has to have some income. The courts will give you some leeway in trying to find it.

Yes you should find a way to prove he has an income reporting him for fraud would be a start if in fact that is what he is doing.

You can file for support as soon as the child is born. They will award something even if it is the minimum payment for your state. If you can prove how much he is making that would be helpful but at least get your first court date as soon as the baby is born. Cases like this can be long and drawn out.
