What if you where in the military staioned overseas and you find out that the mother of your child is staioned at the same base you're stationed at but me as the biological father of the child will be in the states and wanted to get the child while the mother is gone oversea for a year. What would you do? Would you go to court and fight for custody or would you let the mother give custody to her mother and husband until she get back and would you file for any type of custody.

Have you been adjudicated the father and do you pay support? The husband is the presumed legal father until testing proves otherwise.

By mother and husband... you mean she is now married? Also is your name on the birth certificate? You would have to establish paternity and go through family court for your rights
I would file for joint custody and visitation asap before she goes overseas because often the Judge will look at your history of interacting with your child although you do have a very legitimate excuse.
