Sued By credit Card Company. I answered the summons, went to court, was referred to mediation. In between the court date and the mediation date I received a motion for summary disposition, also with that they provided all the statements, the bill of sale, affidavits etc. Nothing with my signature on it. My question is after reviewing the documents, there are 2 different account numbers on the statements. Would this be an issue to bring up in my response, or would I be better off settling with them? Mediation is to be held for the first part of sept.

If you feel that they cannot validate or prove the debt is yours, you shouldn't mediate anything. No proof of the debt being yours, means they can't prevail in court.

Are you willing to take that chance? Do you already know that the debt is yours, and it is valid, and are you willing to risk that they cannot prove it at a hearing?

If so, tell them to go pound sand.

If not, I would do my best to negotiate the lowest settlement possible and settle it.
