Yes, a lot of states used to have a requirement of you being married, but with the large movement to allow people with other lifestyles to adopt, many have changed this, ( so you need to check to see what your exact state requires) Texas used to require married, but one can check with a local attorney

Does he have custody or do you? I ask because you asked if the payments to him would stop. If he has custody then it really does not matter if you are married. Also you have to have a lawyer to do the adoption process. If you let us know which one of you has custody I would be able to give you more information.

Yes, if your husband was willing to adopt and the bio father was willing to allow the adoption then the payments would stop because it would no longer be his child. Which state has juisdiction on your case? The states that I know of that don't reuire a year of marriage require like a five year steady relationship but again I'm not claiming to be an expers on all states.
