This is an extremely long story but I will make it short and sweet.

My son got into drugs and he got into my bank account and stole all my money. We lost our apartment and went homeless. So, as a consequence, I am now into debt, and being sued by Capital One.

Last week went to court on a judgment and they gave me a chance to respond. I would like to know what steps to take since the clock is ticking and I am due in court on the 15th. Thank in advance for any help.

Unless you want to prosecute your son for theft, you owe the debt. You will have to try and make payment arrangements.

How old is the debt? Is it past SOL in your state?

Unless Capital One was the bank that held her checking account, it is her debt regardless of whether she prosecutes her son or not.

She can prosecute him for stealing her money, but that won't affect her debts that went delinquent because of the theft.
