Hi,

I was working in US from 02-Dec-2006 to 03-Nov-2007. I am married and my wife was with me during this period in US.

I have been told by my tax consultant that since I came back before Dec-2007, I have a dual residency. Hence I can't file with status "Married filing Jointly" and I need to file as "Married filing Single".

This is result in more taxes on me. Is this a correct status? Or is there any way by which I can file "Joint" return.

Which visa do you have? On F1 and J1 you are non-resident.
If you have work visa, then for 2006 you are non-resident and for 2007, you are resident in the beginning or the year and non-resident at the end of the year. You will file Dual status tax return. You will get exemption for your wife, but will not get standard deduction.
