My wife an I have a baby on the way. She has 3 kids from her last marriage. We have a court order for child support but we receive none because he refuses to work a job more than a week. He has been to jail for hitting my wife(before we met) and has fought physically with his current girlfriend(and mother of his 5th child). He does take the kids about once a month for 2 days. Usually the 2nd day he is trying to get rid of them as soon as he can. 4 weeks ago the cops were called because he was sleeping on the floor while watching the kids and not waking up. Cops came he woke up and they left. Social services has been unable to reach him by phone and will not just show up at his house. He current girlfriend admits to us of his use of cocaine but it is our word against his in court. On weekends with the kids he stays out till 4-5 in the morning and then sleeps most of the day while the kids play with his mother. He has gotten into physical fights with his girlfriend, and has even choked his mother while my kids were at his house. Someone please help me.

You need to get enough proof of the cocaine use to get the court to force a drug test. You can then use that test to try and terminate rights.

Only problem with this is how do I prove drug use? I mean if he gets busted sure that's easy but until then I would need him to agree to it our get a lawyer and force it. I would prefer not to get a laywer as they are a bit pricey
