View Full Version : F1-H1B: Standard deduction question?

Hello,

My visa status changed from F1 to H1B on the 22nd August 2005. For the purpose of taxes, I have a few questions/ clarifications -

1. I believe that I would be considered as a non resident (since I am under 183 days for resident status) and hence would have to file both 1040NREZ and 8843.

2. For the calculation of deduction, do I split the taxes and apply $5000 (deduction based on US-India treaty) as standard deduction for the part of income earned as F1 and do itemized deduction for the part I earned under H1B and add the two results to determine the tax slab? Or do I consider the entire taxes from both W2 as one and apply the standard deduction based on US-India treaty or do the itemized deduction?

Please help me out with these questions. Thank you very much in advance.

1) Yes, that is correct.

2) Combine the W-2s and apply the standard deduction (or itemized deductions if they are greater than $5,000) and personal exemption of $3,200on just Form 1040NR.
