Hi everyone, I was recently caught stealling an item that costs $40. Securty called the cops and the officer gave me a ticket that said I had to go to get figerprinted and to court. I was caught around 8 months before that for stealling an item that was about $60. The cops were called but they just took down my info and let me go. But the securty guard told me I would receive a letter from the store to go to court and either fight the charge or pay for it and I still have not received that letter.
I was wondering why I got the ticket for fingerprint and court appearance the second time but not the first. Also would I need to get a lawyer. I have never been arrested or in trouble with the law prior to these to cases. Any answere would be appreciated.

Well, I'm a bit mad. I hope you do have to go to court. You've done this twice, so obviously you aren't learning a lesson, so hopefully the courts will decide that it's time you did.
As for getting a lawyer, I would if I where you, but then again, I'm not you and wouldn't be in this situation in the first place.
There are others on this site that can offer you some good legal advice, so wait around, hopefully they can help you.

Well you did not say where you are at some countries will cut your hand off so you won't do it a third time.
Yes I will agree I hope you sit in jail a few nights, since you obviously did not learn anything the first time, and guess what the judges most likely will feel the same way, esp if you get the same judge.
I was working with a young man this week, he could not get his bail reduced, could not get judge to hear a motion to dismiss, guess why, the jduge confused him with someone else ( similar names) and he was tired of seeing that one person, when the guy appeared before the judge the judge said, "who are you" and dismissed it all.

Probably your name came up on the computer - you learned nothing the first time so this time they are going to make an impression on you. Maybe the second store has lower tolerance for stealing than the first.
Yes, get an Attorney. Once your fingerprints are on file you are in the system.

Why did you post twice? The answers aren't going to be different no matter how often you post. You asked for advice, you are getting that advice. I can tell you that Judy Kae and Fr_Chuck know allot about the law and legal issues, so I'd follow their advice if I where you.
It's not what you want to hear, but it is the truth. The fact is, if you steal, sooner or later you will get caught, you claim you only stole twice, and both times you got caught, perhaps it's time to stop, you obviously aren't very good at it.
When you go to court, if you get lucky and the charges are dropped, then learn from this and move on, next time you might not be so lucky.

Sorry everyone, I'm really new to this cause believe it or not I Rarely use the computer and this is the first time I've posted anything on forums. Just need some advice cause I F****d up and when I get through this I will never take anything again.
I'm 24 years old, live in Toronto,ONT. I never received any type of letter or court papers from the first store even though the security guard said I would. He said If I didn't pay then they would sue me in civil court.
My questions are:
1) If the store orders me to pay them a certain amount and I do Pay, will I still get a criminal record.
2) Regarding second time caught where I got a ticket for fingerprinting and court date. Is there a chance that they will consider that my first offence. Since I didn't get that ticket the first time I was caught.
I thank anyone with advice and apoligize if I'm not posting correctly.

My answer was - Yes, and yes, no one knows if you're on the computer or not. There is no way for anyone to know this 100%.
Read through what you've posted and everyone has answered. It's the same question and the answer is still the same DUMBGUY.
