Hi,
I am an U.S. resident alien and will live in and have income from U.S. all year of 2006. I am planning to marry someone (in the middle of 2006) who live in and have income from Hong Kong all year of 2006.

1) What will be my filing status of tax year 2006?
2) If it's "married", am I supposed to file joint with her and report her income from Hong Kong or file separate and not list her income?
3) What other form(s) do I have to fill out for tax year 2006?
4) Is her income from Hong Kong subject to U.S. taxation?
5) If so, can all or part of her income be exclude under the Tax Topic 853, Foreign Earned Income Exclusion?

1 & 2) You need to file Married Filing Separately, unless your future spouse wishes to have his/her income taxed along with yours if you file jointly.

3) If you file jointly, a W-7 to apply for an ITIN.

4) Only if you file jointly.

5) If you file jointly, yes.
