After the 3 days to quit notice was served, tenant did not respond. The eviction procedure was then initiated. After the eviction notice been served by the court, could the tenant pays her rent and tells me that she still is going to stay in the house after all. Thanks

She could, I guess. But you do not have to accept the rent payment and go forward with the eviction.

Accepting the rent will most likely void the eviction process. It's your choice. Make sure the rental payment includes any court cost, attorney fees or late fees.

Depending on the court order,the tenant can cancel the eviction by paying all arrears including fees up to the sheriff showing up to physcially remove them. However, if the tenant is chronically late, you may be able to file the eviction request to preclude this.

Also, is there a lease? If so, when does it expire?
