View Full Version : I had an accident , I was hit by a lady that ran a red light

I live in Ohio I was in a wreck 1and half weeks ago, I was hit because a 67 year old lady ran a red light, I was insured but my policy lapsed, and I had submitted my payment to them , but it wouldn't go into effect till the next day even though I had already paid ,the lady has to go to court, and was cited for this . I had not been able to get a hold of her insurance company she would not tell me anything and the officer only put part on the report so I called him after a week , he finally got the agent now I am waiting a call from them, should I tell them any info about mine, in case it was not acctive or should I even call them, We had 3 witnesses, in this, but the lady was a rude lady. I had 2 children with autism ,and epilepsy with me.. help I am unsure, but my car is severely damaged

How did your policy "lapse"? Was paperwork sent to you that it had formally lapsed as of such and such date and the accident happened after that date? Have you spoken to your agent about this accident? If you did speak to your agent did you give them the little old lady's insurance info that you got from the police?

Your policy isn't likely to pay for the repairs to your car, since the coverage was lapsed when the accident occurred, but they might. It's worth asking about, anyway. If they reinstated your policy, they might be willing to pay for the repairs and subrogate against the old lady's policy to get their money back. If they started a new policy (which the effective date being Monday sounds like they might have), they might not be willing to cover the damage and subrogate. You are entitled to the old lady's insurance information regardless of what your insurer does, though, since she's at fault in this accident. If she had to go to court, just contact the court clerk's office... they'll probably provide you a copy of the old lady's insurance card. I had a neighbor hit my car, deny liability, go to court and be proven liable and the judge handed me a copy of her insurance card while he lectured her on her being a jerk. Since my coverage hadn't lapsed, my insurer fixed my car while the case was pending, then collected from her insurer once it was closed.
