View Full Version : Creating a plan for Transfer of Probation

I have been placed on felony probation in the State of Florida. I have been offered a job
In St. Louis, MO for an IT high tech company making great dollars. I am going to see about getting it transferred and need some help with putting the information together. My questions are as follows from the Interstate Compact of FL:

1. • Offender must have a valid plan of supervision
- What details are they looking for in a "plan of supervision"?

2. • Offender must be in substantial compliance with the terms of supervision
- What do they mean by "substantial compliance"? I have been given 60 days
Before I have to start paying restitution, per the court, to get a job. It has been
20 days so far. Started the Community Service hours and completed the Drug/Alcohol
Evaluation, per the order. Therefore what else would they be looking for?

3. • Offender can obtain employment there
- I have the contract ready to go from the consulting firm to show them I have a job
Waiting for me and a start date for the contract.

4. • Though not a resident of the receiving state and not having family residing there,
The receiving state consents to such a person being sent (discretionary transfer).
- I am not a resident of MO and have no family there. What is the best way to do
A discretionary transfer? Should I contact St. Louis or what?

5. - How do I go about getting a work permit to be able to start work on the contract until
This paperwork moves through the process? I need to be able to start 31 July '08
And would need to get him to give me at least a 30 waiver to start work.

I wish to put all of this information in a presentation as quick as possible to present to my PO and would like some help and guidance in putting this together. Any help would be more than appreciated.

Did you read the "sticky" by excon at the top of the Criminal Law page? That may answer the bulk of your questions. Also there are at least 2 similar questions every day if you use the "search" feature.

Your answers will be posted here. People who participate at Askme will not respond off site. The purpose of this site is to learn and teach and when answers go off the site that does not happen.

I have read the information from Excon. It is very informative, yet I am trying to get an understanding of exactly what they are looking for within the bullet points. Also, removed the information, per your statement. Thanks in advance.

Just starting on probation it is going to be very hard,

They will want to know a address you will be living out, a job you will be doing. The biggest issue is you have not started making repayments, they want to see a history of you making those payments to believe you will do it.

You make application though your PO, they send it to your state for approval to go, if and only then normally they will then send it to the other state to see if they will approve it. And you can't go until you are approved, it can take a few weeks to a month or even two to get it sent though the system.

If you PO oks you to go for 30 days ( I would not hold my breath) get it in writing, we get stories here often where something happens, and the PO forgets all about you being allowed to go. Plus you will have to travel back and forth for PO meetings normally until fully approved, ( again unless PO allows a phone call in)

Also what type of crime will have allot to do with things at time also. Plus of course does your new place know of your record ? Since they will be contacted to confirm you are going to work there.
