My boyfriend is a truck driver (18 wheeler). Originally he was hired as warehouse help at 10 dollars an hour, until one of there drivers were going to quit. After about 4 months he was put on the big truck and was paid a weekly salary. He has been driving for them about 9 months now. He is out 2 or 3 days at a time. Last Friday when he was coming back in town his employer told him they did not need him on Monday because business was slow and on Tuesday and Wednesday they called him and told him he could work in the warehouse (with no discussion of pay rate). He worked both days but was asked to make local deliveries in the truck along with warehouse work. When he got his paycheck he was not paid at all for Monday and was paid 10 dollars and hour for Tuesday and Wednesday. Can they do this? If he is salary shouldn't they have to pay him whether they have work for him or not? Or shouldn't they have to pay him overtime when he is on the road? Can an employer structure your pay to benefit them?
