View Full Version : Breach Contract Commercial Property

These people have broken or Breached the contract in several ways. They have made late payments 3 months out of 4 and I have had to peruse them for payments.
They have failed to make late payments as stipulated in the contract and now refuse to return any calls.
They are starting to trash the place out, and make changes outside the contract.
This is a business property without living facilities yet they have moved in and appear to be renting out space for others to live. One bathroom no shower, and no kitchen.

How is the best way to get them out quickly? They did sign the Contract and one of the Special provisions was that they would pay all legal fees in rergard to any contract dispute.

What would be the best one to proceed in Texas ?

Best way, hire an attorney give them notice of breach of the lease and order them out. When they don't move, you evict.

And then sue them for all the damages and hope you can find some of the money

One quick point, the Contract was a Contract for Deed does this make any difference, that they were buying the property?

Yes. Hire an attorney who is well versed in real estate law. With a contract for deed there are a whole bunch of rules you, the seller, has to follow, so you want to make sure your ducks are in a row before you go after them.
