How long can Jail hold you on a violation Of Probation Detainer in the state of PA Philadelphia County How many days from arrested is it 30-60-90-120 days before you see a judge: confused:

They can hold you until they have the hearing scheduled before the appropriate judge. The times can vary due to the court's calendar. Call up the clerk's office and ask when the hearing is scheduled in that case.

I know without probation they can detain you up to 90 days.
My x wasn't heard in time and was released as time served

Any time served while waiting for the hearing is credited towards the "suspended" part of the sentence.

My husband has been held since 6/28/08 in Phila Pa CFCF for 10 yr.Old Violation of Probation (Tech. Not reporting). He Has court on Monday. Can his probation office ask this judge to release him on both detainers?

Hello m:

I'm sure they can. You can ask a judge to do anything. But, would they, and would the judge agree? And, if they would, why did they arrest him in the fist place?

He had better have an attorney, this is a probation violation and he can be sent to jail or prison to serve the rest of that sentence from the time from violation. And if he has not seen a PO in years and had a warrant, not sure why the PO would do anything for him, They will tell the judge what he has done as for as following rules and the such.

My husband has been held since 6/28/08 in Phila Pa CFCF (County Jail) for two 10 yr.Old Violation of Probation (Tech. Not reporting). These cases are from 93 & 95. He Has court on Monday. Can his new probation officer ask this judge to release him on both detainers?
He had no arrest since 1995 (someone turned him in!). Has Deadly Illness under doctors care. We paid our taxes, own a home. We are having our second child after 15 years. Our son is A-B student in High school. We try to be good people. I know it was wrong for not reporting for that long time. But would any of this count to the judge?
I'm looking for hope that he will be home soon. I lost without him.

He had his choice of going to jail OR meeting certain requirements and staying out of jail. He choose the certain requirements - probation - and didn't meet them.

He could now go to jail to finish his sentence, particularly because he appears to have been on probation in 1993 and didn't finish and again in 1995 and didn't finish.

I don't know if it's necessary to turn him in. He undoubtedly had warrants out on him and that's why he was arrested.

I doubt that the Judge will just let him walk because he has promised to meet certain conditions twice before and has not. Often people skip meetings with the PO because they don't want to do mandatory drug testing - why did your husband skip the meetings for 13 years - ?

I don't think your pregnancy, your son's grades, your owning a home, will mean much to people who have been looking for him since 1995.

Have you known about this the whole time or was this a shock to you - ?

Allot of it may matter to the judge but then it may be an election year and he is running on get tough on crime, also what the original crime was. He of course needed to clear this up years ago and waiting 10 years to finally get caught will go against him also.

So that is why he needs an attorney.
