View Full Version : How to file a lien on real estate in NY state

Hi my question is: I won a small claims judgement in NY state where I reside in regards to road work on our shared private road with a road agreement in place. I want to file a lien on this persons real estate ( a parcel of land)Also in NY state. I went to the small claims to acquire a Trascript of Judgement as per the small claims guide book... Now here's the question-How do I file a lien on this property myself (as the claim is less than 500.00 dollars) I just need to know the next step AFTER acquiring the Transcipt of Judgement in NY state.

Do you really want a lien, not up on the garnishment laws, but would you rather not go after a bank account, or a payroll check, something that will actually get you money.
On the lien you have to wait till they sale the house or they die and it goes to probate to get your money.

Thanks but she works off the books and has no verifiable income,a junky car,and no known assets and 50 different addresses and akas.The only thing I can go after is her property.Any suggestion on how to do this?

Go to your local county clerk's office and ask there. They will know the procedure and have any necessary forms.
But as Chuck pointed out, that's not likely to get you your money anytime soon.

Actually I called the County Clerk this morning and spoke to the lien recorder (the person that records the liens) All I need is the transcript of judgement (wich I have) and a 10.00 filing fee and this will put a lien on any real estate she owns in this area. Maybe someday I'll collect, I wouldn't loose any sleep over this... However it's just a cruel reminder of the kinds of people that live among us!! Thanks all for your help,But I think I over thought this but it's actually very simple process...
