View Full Version : Child Support? When? How?

I want to know if I can start child support proceedings on an unborn child. My husband left and I am pregnant. So I want to know when to start. Also he has not been working for at least a year because he had some life insurance money to live on and decided to take some time off. He will have to go back to work soon because the money is almost gone, but if he doesn't before we start the proceedings will my baby get the short end of the stick. It already isn't going to have a father around, because my husband doesn't want the child. I just want what I can get for him for my child since he is begrudging my child a father. If anyone can answer this I would appreciate it. Thanks

You have to wait until the baby is born. After the baby is born he will have a chance to sign the birth certificate. He will mostly likey (in most states) be presumed the father depending on how long you were married if the dates of conception and you being married match up. Once you get out of the hospital you will have to go to court to get an order for support are you divorced yet? Or filed legal separation yet? The separation/divorce proceedings can get started now and that will be that much less to do after the birth.

You can have your attorney start the paperwork and be ready to file as soon as the baby is born. But it can not be done until the baby is actually born, If he is not working the court may take into consideration the money he has in the bank. But there is a min amount each state will order. Also after he starts back to work and has a higher income you may go back to court to request a higher paymennt

Are you separated? You can file for divorce and ask for alimony and money to pay debts; child support will be determined after the baby is born.
