View Full Version : Do I have to inculde all debts in a bankruptcy?

2 of my bank accounts have liens on them as of 2/25/08 by 2 different law firms.. I had a credit card during this period but when they took all of my money ( my entire paycheck as well) I could no longer keep up the p[ayment, my rent is behind as well as my light bill, gas bill etc... I looked into filing bankruptcy and will be going to see a lawyer (pro-Bono) on Friday 7/18/08... what can I do , or do I have to include the current credit card as part of the filing or can I ask that the credit card be left out of the bankruptcy so that I can make payments?
Another question is I had a lien placed on my account in Feb. 2008 and then another lawyer placed a lien on my new account in May 2008 I have been looking for help on this for months , can I get the liens on the accounts lifted so that I can catch myself up with rent etc...

You can file only what you want to and continue paying on what you want.

Welcome to AMHD. As for your bank accounts, change banks immediately. All of your debts must be included in your bankruptcy; leave none of them out. If you have a credit card with a zero balance, you do not have to list it. You need to file immediately and possibly stop your money from being disbursed to the creditors. Call the attorney's office tomorrow; ask what do you need to have on Friday to file immediately. Some attorneys file electronically, so you will need to see how much of your filing fee to have with you. BTW, filing fees can be paid in installments. As soon as you have a case number, fax a copy of your petition with case number and date of filing to the bank(s), your creditors involved with the levies, and the attorneys. Demand that the levies be released and find out who to contact at the bank to get your money. You will have to have the names and addresses of all of your creditors for an 'emergency' filing. I was saying you have to take it all to bankruptcy but let them know what ones you want to continue paying on
