Hi,

I did not file any tax return (1040) until now. I'm not sure if I have to pay some tax or will get refund. However, I want to file FICA tax refund form 843 as I've been withheld for SS/Medicare tax from my paycheck in year 2007 while I'm working under OPT (F1) program.

Questions:
- Will I still be able to file 843 for refund?
- Will I have to file 1040 together with the 843? Or I can just file 843 alone.

Thanks very much

1. Yes you can still file your tax return and Form 843. Both must be filed separately.
2. You must file nonresident tax return. You can not file Form 1040. Read: Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents (http://taxipay.blogspot.com/2008/03/us-tax-filing-requirements-for-non.html)

The filing deadlines for Form 843 is the same as for the annual tax return: you have until 15 April 2011 to claim SS/Medicare tax refunds for 2007.
