View Full Version : Shared Physical Custody of 18 year old?

Hello,

My ex husband and I have had shared physical custody of my now 18 year old son for the last 10 years. Now he is going off to college in Baltimore MD. I recently moved to New Mexico from Massachusetts in December 2007. I volunteered to pay him child support for the remainder of the year until he went off to college, then I thought we could resume shared custody. But now my ex says "No!" and has gone after me for a modification of our original agreement and continued child support while my son is in college. Is there anyway we could go back to our original shared physical custody, sharing him on holidays and summers without child support?

If you can't agree you need to go and have the Judge settle the support
As far as visitation your son is 18 now so you can decide between each other on visitation but ultimately it is up to your son if and when he bothers visiting who

At 18, your son can now decide who he lives with for how long. So a judge is not going to rulke on custody or visitation. They will rule on support though.

Your Son is 18 now can go where he wants... You should be giving your son the money directly not your ex. Child support ends when the child turns 18. I opened up a Teen checking for my daughter and I put money into that for her. This teaches her how to budget her money and its for her to spend or hopefully save
