View Full Version : 2 children and dispute about moving out of state

Hello everyone.
My wife and I are not divorced yet, but plan on it. We moved to a small town and I was was laid off. Am now working but very little opportunity here. I want to move out of state back to a bigger community for more opportunities, but she wants to stay. We have 2 young children. I assume if I wanted to move before we got divorced and take the kids she could somehow stop me. Is that correct? I know the drill once we get divorced. The judge would determine what they felt is the best place for the kids. Any thoughts on when it is easier before the divorce or after? I still make quite a bit more money than her and we are equally involved with our children's lives with the exception to the schools where I have pretty much been the person at all the meetings, etc. thanks for the help.

Welcome to AMHD. You sound like a reasonable fellow. Why don't you look into family counseling? Perhaps the spark in your relationship can be recharged. You can also review the circumstances surrounding what is in the best interests of your kids. With a counselor, you can do this with your wife and the kids' mother; who could be any better for this discussion? It doesn't make a lot of sense to just toss it to a judge, who knows neither of you nor your kids. If you get into a full-blown fight, especially over the kids, you may wind up paying alimony, as well as child support ("I still make quite a bit more money than her").

You seem like a very amicable guy through your divorce process. What is the main concern in any divorce?? THE CHILDREN. If you can offer the kids a better life as far as more money for activities such as sports etc.. for them and better schools then your soon to be Ex should be on board with this move, it's there well being that is important and who know a knew city may bring the two of you back together... Ask her to come along it would be a new adventure for all of you... how old are your kids??
