Heloo Tax Expert,
I was on F-1 visa as student from Jan 2005 - June 2005
OPT on F1 visa from July 2005 -->November 2005
H1-B in December 2005 for 1 month.

I think I qualify as non resident alient and should fill out form 1040NR.
Also am I qualified for both 5000+3200 deductions/exemptions?

During my OPT I wokred as 1099 Misc, so can I also claim some itemized deductions for that?

Ashish:

You are a non-resident alien and should file Form 1040NR. You need to also file Schedule C for the Form 1099-MISC income. You can claim deductions for expenses associated with the Form 1099-MISC income on the Schedule C.

If you are an Indian national, you can claim the $5,000 standard deduction and the $3,200 personal exemption.

Yes I am an Indian national. So that means I can claim 5000 + 3200 + Itemized deductions.
I was unsure if I can claim all 3 of them.

You can claim the $3,200 personal exemption.

You claim the $5,000 standard deduction

OR

The itemized deductions.

Whichever is greater.

But NOT BOTH!
