It's 6:30 pm on Sunday, the apartment complex office is closed. What do I do about my upstairs neighbor BLASTING his music. And when I say blasting, I mean not only can I identify the words to the song, but the pounding of it loosen a light bulb.

P.S. I am also kind of afraid of retaliation from him. He always complains to me about my dog barking, but doesn't complain to the complex.

Your only choice is to either go up and knock on his door, or call the police or ignore him

Ugh, I don't like any of those options. I've been ignoring him since I already went upstairs and rang the doorbell three times. He must not have heard me since his effing music was so loud.

If you have his number try ringing him, or bang louder

You could do one of two things. I had horrid neighbors next door in a 2 story townhouse who would play rap crap very loud at all hours. Very thin walls. I went to a truck stop and bought the most obnoxious hillbilly tape you could imagine. Good Ole Mountain Dew and other redneck favorites. Played that at the loudest setting possible that I had. They couldn't stand it and would leave within 15 minutes not wanting to hear the rest of the tape. Oh gee, I felt bad that they didn't stay and enjoy the hootenanny. But then they were druggies and not very nice people. OR you could call the police about the noise level. If the noise is that loud you could tell the operator (don't call 911 but call the non emergency line) that you have a horrible migraine headache and you are very ill and the music is making you more ill. (but don't mention going to the hospital). Sometimes they will come out and tell the other person to turn it down, sometimes they don't do this as they are busy. If you seem very nice and not demanding that works sometimes.

Then, tomorrow when the mgt office opens, go and speak to them about the loud stereo. You may or may not have anything in your lease about playing loud music regardless of what time it is. Or you may have to suffer until the "noise ordinance" times kick in which are usually around 11PM to 7AM. I had a neighbor in Florida who played his acid rock music so loud that even though I slept on the floor of the diningroom some 30' from my bedroom I could still feel the floor vibrate. I also had horrible migraines at the time and if I died I would have definitely felt better.

If you call the police on him he could possibly use it for an excuse to retaliate and call the police every time he doesn't want your dog to bark. You should first find out what the laws about noisy music and the laws about barking dogs are. Many places people can have their music up loud until 10 or 11 pm and dogs are considered a nuisance enough to call the police after they bark for 10 to 20 minutes.

Here where I live a dog can bark until he is hoarse and the police won't come. I had a neighbor who left his barking dog in his home for 2 weeks alone. He barked until he was hoarse and then kept barking. They refused to come. I had to listen to this poor animal day in and day out until they returned. If he was outside I could have done something about it, but inside a house they could not.

If he left it at home alone for two weeks straight someone should have called the humane society and they would have got him for neglect.

No Help - we tried that avenue and it didn't work. They came and looked in the windows and could see a huge bag of dog food and they could see the dog drank out of the toilet. They said there was nothing they could do about it. Yes, they do things a$$ backwards here I know. We were annoyed to put it mildly. We DID try to no avail. The guy was a truck driver who was gone for weeks at a time. The only thing the SPCA cared about was the fact they could see the food and the water. It didn't matter that the dog poop was piled up to the ceiling. That was irrelevant. And no, they didn't get cited for neglect either.

Id still recommend trying just talking to him first, before just going and reporting him

Thanks Twinkie! I'm moving in four months! Mostly because of this, but also because this place isn't that nice, and they raised my rent AGAIN (3rd time in a year) to $735 for a one bedroom, the median around here is $650.

Here's an interesting analysis: "Under the doctrine of constructive eviction, a judge may determine that a tenant who has been deprived of quiet enjoyment of a rented dwelling is justified in vacating without responsibility for payment of rent for the remainder of the lease. Unfortunately, it is impossible to predict whether a judge will find that the doctrine of constructive eviction applies in a given case. For this reason, there always is some degree of risk for the tenant who decides he no longer can tolerate disturbances or lease violations and vacates prior to the end of the lease." My lease is up in one month... I misread my lease. I'm doing research online right now.
