View Full Version : Lying? Or Aggressive - car repo - Felony?

I live in Vegas, My best friend has recently separated from his wife in Colorado, and is here trying to start over. The wife is not/has not made the last 3 payments on their mini-van, although he has deposited that money into her account every month, she didn't send it to them just to be vindictive.

She called last night and said the repo company has been to the door and is threatening to serve her with a felony charge for not disclosing where the van is at. The loan agency is not willing to work with him because it is still in both names and he should know if the payments are made or not.

Now... can they actually charge her with a felony for not disclosing the location of the van?

Is there anything he can do or say to keep his van?

He doesn't have the $1466 right away to satisfy the past due, but he needs the van to work since he has a delivery job using that van.

Although she did mess up and not make the payments, he doesn't want her to be charged or arrested over a vehicle.

No, the threat of charging her with a crime is a lie. The only way she might be in trouble would be she had to testify in court, under oath. And that's unlikely to happen.

Did she actually spend the money he deposited? She should be the one to come up with the money. He can sue her for not making the payments.

He should write the creditor and explain the situation offering to pay what he can towards the arrears and to offer a schedule for bringing the account up to date. They really don't want to repo the car, if they can get payment.
