My son's father lives in the state of Indiana where I live now. I am wanting to move back to IL where I am from. I have cutsody of my son but he pays child support and has visitation everyother weekend. Do I need permission to move out of state? And if I do, how do I get said permission?

Yes you do. As long as there is a court ordered visitation agreement you cannot move without modified the court order. You need to go back to Family court and petition for a modification.

Yes, you are obligated to let the court know if you are chaning addresses. Have you dscussed this with their father at all?

She not only needs to notify the Court of a change of address, she needs the Court's permission to make the move and take the child farther away from the father.

I was responding briefly hoping that she would give a little more information about the circumstances. You are correct she needs to get permission. That was her orignial question.
