View Full Version : Am I permitted to move out of state?

My husband and I are divorcing. He is in the Army has not been an active part of our son's life. He is now trying to get visitation with our son etc. He is stationed out of Ft Bragg in North Carolina and I live in Indiana with our son. My husband is also from In. but will be not be living here as long as he is in the service which is at least till 2011. I want to move to Florida where I can start my life over. The town to which I would be moving which I also have family living there is about the same distance from Bragg as where I am now living. I am wondering if I got a better paying job and wanted to move if I would be allowed to do so because of the fact that my husband does not reside here in Indiana? He is already complaining about driving up here to see our son and that being military he will not be guaranteed even every other weekend to visit with him. I don't want to push him out of our son's life I just want to get out of where I am currently living. FL. Being the same distance he would just drive south to see our son instead of north. Do I have a good chance of relocating with our son getting approved by the court?

As far as I know that shouldn't be a problem.

Have relocation written into your final Judgment of Divorce - or have the number of miles you are allowed to move written into your divorce.
Will your move to Florida cause your husband to see your son less frequently? If so, you might very well have a problem with this.
If the mileage between him and your son would be the same if you move, I don't see a problem. Otherwise, I do.
If your job transfers you, well, that's a slightly different story, more in your favor.
At this point in time with a divorce pending you are most probably not allowed to make any changes at all.
