View Full Version : Credit Card Judgment which doesn't belong to me

I have received back in April a letter from a law company here in WA with a copy of judgment entered in NY for some credit card. The name on judgment was mine, but the address was the one I have never lived on. More so the judgement was never on my credit report and neither was the address. Well, I have sent them a copy of police report I have made out few months before for identity theft, called them and left a message, didn't get a response to either... instead got a judgment entered based on NY here in WA, called the court they said that this is just registration which is not enforcable, nothing for me to do. Ok, I've sent the law office another letter and copy of police report and left another message, no response. Now I get a letter w/cpy of NY judgment saying that they will put hold on my property... What am I supposed to do? They don't return any of my phone calls and ignore any of my letters and faxes... can they just do it?

My advice is to get your own lawyer! When it comes to legal action, a lawyer could give a crap less what you say... but they will turn their ear toward another lawyer. I know that it could be expensive, but not as expensive as loss of property! Plus, a lot of them at least have free consultation and payment plans. It is not hopeless!

Getting atty is not an option unfortunately. Is there anything that I can write them that will make them take me seriously?

File a motion in your local court to vacate the judgement based on improper service and mistaken identity. If you can get the judgement vacated in WA, you might be able to use that to get it vacated in NY.
