I moved into a house with another person and we are both on the lease. After one month we realized that we could not live together. I get the other person the option to take over the lease and I would move out or I would take over the lease and they would move out. They wanted me to move and said they would take over the lease. What are my rights about getting my deposit back and is the other person liable for the full rent

If your roommate will put up the other half of the deposit, and if your roommate has the credit standing, and IF your landlord will LET you off the lease and give you back your deposit, then you're cool.

But, the landlord doesn't have to let you off the lease and probably won't. Why should he when he has TWO people to go after if the rent isn't paid instead of one person? Certainly your roommate should pay the rent, but you can be sued if your roommate doesn't pay, or damages the place.

You really have NO rights.

The landlord will have to let you out of the lease. The other tenant will have to pay your deposit amount to the landlord most likely. But the landlord can hold you liable for the lease unless they let you out.
