I was driving to work.the car in front of me was driving fast and suddnely stopped the car at the yellow light with sudden break and I couln't expect that and I hit her car .but she came out and saw the accident and drove away. Now she is telling she didn't know that her car got damaged so she drove away.now caiming for insurace for her repair.
Somebody told me if she drove away all her fault we don't need to pay . Who has to pay my car repair , and who has to pay her repair,

This is not quite in line with your original post.

Do I have this straight? You hit her car, she saw the damage and left. Now you think she is responsible for your damage? The car in front of you was driving fast and stopped suddenly at a yellow light? You are supposed to stop at yellow lights and should have been prepared for that eventuality. The speed of the car that stopped has no bearing; your speed does.

How is this her fault? Keep in mind I investigate accidents - your statement "I couldn't expect that and I hit her car" has just placed the responsibility very definitely in your hands.

If "she" just left the scene, how do you know she was DUI?

Your insurance pays her damage; your insurance pays your damage - unless there is some other circumstance here that I'm missing.

Excon had a good question - how much were your medical bills? Next question would be - why did you lose time from school and tuition?

Confused by the piggyback thing, particularly early in the AM. Never been much of a morning person.

Thanks for the catch - my thoughts on the cause of the accident stand. Scratch the DUI and tuition.

Hopefully, somebody will move your post. It causes confusion, as you can see.

Whoever told you that if the other driver leaves the scene that means that you don't have to pay, is WRONG. You hit her from behind. You are at fault. You have to pay to fix her car, and you have to pay to fix your car.

If you have insurance, they'll be the ones doing the paying... But, you don't have insurance, do you?

My one answer to two posts confused even me - you hit her in the back. There can be extenuating circumstances but you have already said she stopped suddenly, you weren't expecting her to stop, you hit her. You are supposed to have your car under control at all times. It's your fault.

She then drove away. I question the "drive away" part because it appears she did more than look and drive away - somehow you got her insurance info and she got yours.

You are responsible - unless there is some other circumstance you haven't shared - for her damage and yours.

Driving away has nothing to do with fault.

As for as who is at fault, you are at fault for the accident, a driver has to have their car under control to be able to always stop if the car in front stops suddenly. i.e. kid running into the road, dog, or stop light changing. And in most states you are suppoe to stop if it is changed to yellow.

The issue of her looking at it, is only the issue that what was damaged, did you look at it, What damage is she now claiming ? Did she do new damage she is trying to collect for?

So your defense would be that there was no damage at the time of the accident, she looked and it was fine. But as to fault, you are at fault for the accident.
