I am in the food service industry in New York and I resigned from my job as Head Chef. This was a salaried position and when I left I worked one full day in the current payroll period. My question is, seeing as I was a salaried employee and only worked one full day in the current payroll period am I entitled to a full week pay or does my ex-employer have the right to pro-rate my pay for that week. Thank you for any help!

Sorry, but you only worked one day and you'll be paid for one day. Salaried means that you work the whole week for a certain amount. Quitting kind of negates this train of thought.

I will disagree with twinkie on this one, salary is that you are paid for the week regardless of how many hours you work or how many days you take off normally.

If I was salary and worked any part of a week I would expect full salary for that week. I am not sure how the labor board will view it but I would most certainly ask for it.
