View Full Version : Judgment placed despite up to date payment program

I recently had a civil judgement placed against me in Massachusetts for about $13k. Can they take my Federal Stimulus check which is due to me in July? I am awaiting a small State tax refund which I am pretty sure they can take.

The original summons was sent in 2006. The Lawyers office told me they would not request a judgement as long as I made my promised payments. I have been making the promised payments for 3 years. Recently they decided to file the judgement anyway. Do I have a chance to remove the judgement seeing how I did not go to court in 2006 because they told me if I made the payments I would not have to? THe only reason they would have executed the judgement is because they were requesting an asset summary from me which they were sending to the incorrect address.

Can I assume you did not have the 2006 agreement in writing?

And Can I assume you did not show up in court to defend yourself on the judgement, by showing your record of payments and telling the judge you had an agreement with the lawyers office?

I doubt if at this point they will get the IRS check But you should have went to court to defend the judgement.
