My ex- boyfriend and I have a 10 year old son and he never pays the child support on time or visit on the regular basis, more like once every 8 or 10 months or when he gets a new girlfriend, how long do I have to wait to ask the court declare abandonment. We live in Florida

Abandonment is dropping the child off at a bus stop, not refusal to visit or pay support.

What you want is to take away his rights, this is different and you will have to file and see if the court
But you don't have grounds.
The law in Florida allows some things but just not visiting the child, and even just not paying child support are not grounds.

When he does not visit, he is just not using his rights, when you don't drag him back into court and fight for support you are not fighting for your right
