please i am extremely desperate. My sister died in october of 2007 and her ex-husband had custody of their son and he won't let any one in my family see him not even his grandmother. Is there any legal action i can take to get visitation of him. I don't want to take him away i just want to see him.

Unfortunately there are no laws for rights for grandparents, aunts or uncles.
They are starting to fight for laws for grandparents but it is going slow.
If and when you ever get a chance reassure him that if it were up to you he would be a part of your life.

Actually grandparents do have rights in a large percentage of states. But aunts and uncles don't.
Your mother should consult an attorney as to what she would have to do to secure visitation.
But first, you all should try and meet with the father and see why he won't allow visits and maybe work something out.

No help - there are rights for grandparents to see the grandchildren. There are no rights for aunts and uncles though, sorry.

I know grandparents are gaining rights but from everything I have looked up they often have to go through hoops to get some.

True its not easy for a grandparent to get visitation rights, but the laws are changing and a large proportion of states have codified grandparents rights.
