View Full Version : Can a condominium ban pets?

I am a resident of California and It is my understanding that a condo can not ban pets completely, but there is a grand father clause. Can anyone elaborate on that for me?

I believe condos can make up their rules -

If you can ban children I would think you can also ban pets.

I know you can in NYS.

I find no law on this.

If there is a grandfather clause, it would be that people who had pets before the ban took affect would be allowed to keep them until they died, but not be allowed to get new ones. Although this may be different between mostly-rented condos and mostly-owned condos.

They can put restrictions on pets, yes. Think of it this way: a condo association is really just a small town, and they can make any laws that they want if the homeowners agree to them. The restrictions I am used to seeing are "dangerous breeds" and sometimes weight limits (pets under 40 pounds seems to be popular.) Keep in mind that condo associations cover a broad range of housing types, from fully detached homes (which tend to have the fewest restrictions) to multi-story apartment-style buildings (which tend to have the most restrictions).

Well, technically the condo board can only ban pets if the membership either votes that pets be banned or, if there is a ban, doesn't vote that it be revoked so it's really in the hands of the condo owners.

A condo association exists for the benefit of all owners. They can set rules, even draconian ones, on the condo owners. Of course any rules have to be agreed to by a portion of the owners. Such things are spelled out in the by laws of the HOA.
